RESIGNATION/TERMINATION


• The company reserves the right to terminate the employee’s services/employment at any time without giving any notice or payment in case he/she is found guilty of illegal activity, Poor Performance, Misbehavior, Misconduct, Willfully breaching or habitually neglecting the duties that are required to perform under the agreement.


• In case your services are terminated, company may ask you to serve 15-30 days of Notice period. A similar notice will have to be given by you in case you wish to leave the services of the Company. No type of leave may be availed during this notice period and you will be required to fulfill your professional duties, achieve the target for the entire duration of the stipulated notice period. However, during the said notice period if and when the company so desires and /or directs you shall be available to attend to the duties and perform satisfactorily. If, the same are breached by you, the company shall be entitled to take such steps as advised. If in case an employee leaves the organization without serving the above said Notice period, the company reserves the rights to annul the salary of that particular month.


• Employee’s resignation will be effective only when the management accepts the same. An employee shall not have the option to withdraw the resignation after it is accepted, unless the management decides to do so at its own choosing. After the acceptance of termination or resignation the clearance of full and final will be settled within 45 working days. A complete KT should be hand over to company before resignation. . 6 Month support is to be given.


• Any employee who is on leave without seeking permission in writing/over mail from his/her Reporting Manager/Senior management for more than 7 days will be treated as a termination case.


• The Company reserves the right, to relieve you on a date prior to the date of expiry of the notice period without paying you salary, incentives whatsoever, in lieu of the unexpired portion of the notice period. The Company also reserves the right, if work exigencies so demand, to not relieve you before the expiry of the stipulated notice period.


• On the termination of your employment for whatever reason, you will return to the Company all property; electronic devices, documents and paper, both original and copies thereof, including any samples, literature, contracts, records, lists, drawings, blueprints, letters, notes, data and the like; and Confidential Information, in your possession or under your control relating to your employment or to clients’ business affairs.


CONFIDENTIAL INFORMATION


• During your employment with the Company you will devote your whole time, attention and skill to the best of your ability for its business. You shall not, directly or indirectly, engage or associate yourself with, be connected with, concerned, employed or engaged in any other business or activities or any other post or work part time or pursue any course of study whatsoever, without the prior permission of the Company.


• You will not be entitled to accept, whether directly or indirectly, any other job or transact any business of any kind, whatever, during the course of your employment with the Company.


• You shall neither during the Employment (except in the proper performance of your duties) nor at any time (without limit) after the termination thereof, directly or indirectly, disclose to any person, Company, business entity or other organization whatsoever; any trade secrets or confidential information relating or belonging to the Company including but not limited to any such information relating to clients, clients lists or requirements, price lists or pricing structures, sales and marketing information, business strategy, plans or dealings, employees or officers, source codes and computer systems, software, financial information and plans, designs, formulae, prototypes, product lines, services, research activities, any document marked ‘Confidential’ (or with a similar expression), or any information which you have been told is confidential or which he might reasonably expect the Company would regard as confidential, or any information which has been given to the Company or Associated Company in confidence by customers, suppliers or other persons.


• You must always maintain the highest degree of confidentiality and keep as confidential the records, documents and other Confidential Information relating to the business of the Company which may be known to you or confided in you by any means and you will use such records, documents and information only in a duly authorized manner in the interest of the Company. For the purposes of this clause ‘Confidential Information’ means information about the Company’s business and that of its customers which is not available to the general public and which may be learnt by you in the course of your employment. This includes, but is not limited to, information relating to the organization, its customer lists, employment policies, personnel, and information about the Company’s products, processes including ideas, concepts, projections, technology, manuals, drawing, designs, specifications, and all papers, resumes, records and other documents containing such Confidential Information.


• At no time, will you remove any Confidential Information from the office without permission.


• Your duty to safeguard and not disclose Confidential Information will survive the expiration or termination of this Agreement and/or your employment with the Company.


• Breach of the conditions of this clause will render you liable to summary dismissal under clause above in addition to any other remedy the Company may have against you in law.


• The employee will be held responsible by the company if they release the information regarding the company’s any project to an outside source. In such case, the company can take legal action against the employee and he/she will have to pay the total amount of the project to the company.


APLLICABILITY OF COMPANY PROFILE


The Company shall be entitled to make policy declarations from time to time pertaining to matters like leave entitlement, maternity leave, employees’ benefits, working hours, transfer policies, etc., and may alter the same from time to time at its sole discretion. All such policy decisions of the Company shall be binding on you and shall override this Agreement to that extent.


ACCEPTANCE OF YOUR OFFER


• If the foregoing terms and conditions are acceptable to you, please confirm this in writing indicating your understanding and acceptance of the terms in duplicate copy of this letter, which should be signed by you and returned to us.


• In case of any difference or inconsistency the policy guidelines shall prevail and be binding.


• We are pleased to welcome you to our organization and look forward to a long and happy association.


Developer’s rules


• The developer has to perform the tasks allotted to him/her on daily basis, if they failed to do so, the company can expect them to work in extra hours or a complete weekend to avoid delay.


• The developer is not allowed to share any confidential information regarding any project or internal matters of the company. In such cases, the company can take legal actions against the employee and he/she will have to pay the complete amount for the project to the company.


• The company expects you to work during the company


• If the developer wants to resign from the company he/she will have to serve a notice period of 2 month. Also, you are expected to complete any ongoing project that you started with the company before leaving or until the company finds a suitable replacement for that project. If you will not serve then you have to pay the salary amount of 2 month.


• A complete KT should be hand over to company before leaving. Salary will not provide until KT, Unit Testing Report is not given to company.


• Freelancing is not allowed if company caught you in doing ,company is allowed to take legal action


• Upload Code in GIT daily -If not done then company is allowed to deduct the salary


• Code will be uploaded 2 times on Github.


• Revert on every mail is required; otherwise company will understood it’s your Positive approach from you towards mail.


• Before taking any type of leave, company should know before otherwise company has full permission to deduct your salary.


• If you want any emergency leave the company has full right to accept or deny your request.


• If you want to leave the company immediately and you are on the running project ,then you have to pay the amount of project you are working on


• Handover the all the credential before leaving.


• All employees are expected to present the output of the whole week on every Friday during meetings on regular basis.

Sales employee

• The employee will be given a specific target for leads and duration to achieve that target, if you fail to do so the company has the right to deduct your salary.


• If no output is recorded from you with three warnings then the company has the rights to terminate you from your job.


• The employee is not allowed to share any of the company’s client information or any project information to an outsider or else he/she will be terminated with fine.


• The employee is expected to submit every document, id and passwords provided to him/her when they leave the company the final day.


• The company can take legal action against the employee if they use any confidential information or communicate to any client for their personal benefits.


• If the employee performs well and achieves the target, he/she will get 5% incentive.
